For a great definition of spam, Samhaus.org offers this definition:

Regardless of what you may feel you're sending in terms of email, the above definition is generally regarded as the correct definition of spam.
Unless you are sending anonymous emails (and why would you do that if you feel you're not spamming?) then even if you do mask your IP in the emails, you can still be reported as a spammer.
No, using Hide My IP cannot stop anyone from reporting you to your ISP.
Anyone who spams using the Hide My IP software will have the unlock key code disabled and there will be no refund on the purchase.
