Premium High-Speed Service Terms of Use Agreement

1. THIS IS AN AGREEMENT BETWEEN YOU AND MY PRIVACY TOOLS, INC.

This agreement ("Agreement") between you and My Privacy Tools, Inc. ("My Privacy Tools, Inc.") governs your use of the Premium High-Speed Service (“Premium Service”) provided by My Privacy Tools, Inc. By subscribing to and using the Premium Service, you understand and agree to every provision in this agreement.

2. AGREEMENT MODIFICATION

My Privacy Tools, Inc. reserves the right to change the terms, conditions, and notices at any time under which it offers Premium Service with or without notice. You are responsible for regularly reviewing this agreement for changes. Your continued use of the Premium Service after the effective date of such changes constitutes your acceptance of and agreement to such changes.

3. MONITORING

Although we do not keep content logs of Premium Service use or share any of your private information with any third party, we will turn over any information we do have if required to do so by law. My Privacy Tools, Inc. may monitor certain aspects of the Premium Service to manage abuse, maintain and/or improve service.

4. LOCATION FOR RESOLVING DISPUTES

You hereby agree to the exclusive jurisdiction and venue of state or federal courts in San Diego County, California, United States in all disputes arising out of or relating to the use of the Premium Service.

5. EXPORT CONTROLS

My Privacy Tools, Inc. products and services may be subject to U.S. export controls. Access to the Premium Service is prohibited from any country to which the United States has embargoed goods (Cuba, Iran, Libya, North Korea, Sudan and Syria) and from any organization in the United State's Commerce Department's Denied Parties List.

6. DISALLOWED USES OF THE PREMIUM SERVICE

My Privacy Tools, Inc. is not responsible in anyway for any damages or losses, either directly or indirectly, arising from your use of the Premium Service, or by your inability to use the Premium Service. You agree that you will not use the Premium Service to threaten, harass, or abuse others; invade the privacy of others; infringe the copyright and/or intellectual properties of others; or do anything that would be considered illegal. You will not use the Premium Service to transmit in any way, unsolicited bulk e-mail or spam. My Privacy Tools, Inc. may suspend or terminate access to the Premium Service for the customer as a response for policy violation. No refunds shall be given for accounts terminated due to policy violations or violations of this agreement.

7. TERMINATION; ACCESS RESTRICTION

My Privacy Tools, Inc. may terminate this Agreement, or terminate or suspend your access to the Premium Service at any time, with or without cause, with or without notice. Upon such termination or suspension, your right to use the Premium Service will immediately cease. My Privacy Tools, Inc. also reserves the right to refuse service to anyone at anytime for any reason.  To cancel your Premium Service subscription, you must visit our Premium Service cancellation page located here: http://www.hide-my-ip.com/cancel_premium.cgi.  Your Premium Service subscription will not be canceled until you cancel using the Premium Service cancellation page and you have received an E-mail confirming your subscription has been canceled.

8. RENEWALS

Premium Service accounts are automatically setup for automatic recurring billing until the Premium Service subscription is canceled. You agree that while your account is setup for automatic billing, your account will automatically be renewed at the end of your subscription period and your credit card or PayPal account will be billed accordingly.

9. REFUNDS

There are no refunds for the Premium Service. My Privacy Tools, Inc. does not issue credits for accounts cancelled due to policy violations.

10. NO WARRANTY

THE PREMIUM SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, THERE ARE NO WARRANTIES, REPRESENTATIONS, CONDITIONS, EXPRESSED OR IMPLIED OF ANY KIND. THERE IS NO GUARANTEE THAT ACCESS TO OR USE OF THE PREMIUM SERVICE WILL BE UNINTERRUPTED, MEET YOUR REQUIREMENTS, OR BE ERROR-FREE. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE FACE OF THIS AGREEMENT. MY PRIVACY TOOLS, INC. HAS NO LIABILITY OR RESPONSIBILITY FOR THE DELETION OF, OR THE FAILURE TO STORE OR TRANSMIT, ANY CONTENT OR OTHER COMMUNICATIONS OF THE PREMIUM SERVICE.
